An employee of the Pakistan Agriculture and Research Centre petitioned the Islamabad High Court through Mr. Omer Ijaz Gilani, Advocate Supreme Court, against its termination for the second time on the basis of same allegations as were leveled against him previously. The Appellate Authority, Board of Governors, had already conducted a through inquiry into his guilt and found noting against him. He was reinstated by the order of the IHC but the department once again terminated him on the same allegations. He once again approached the IHC and asked for his reinstatement.
The case was heard by Honorable Justice Mosin Akhtar Kiani who, after recording submissions of both the parties, held that the termination was illegal, perverse and it amounts to double jeopardy, offending articles 4, 9, 10-A and 13 of the Constitution. Hence, the department was directed to reinstate the petitioner forthwith with all back benefits.
