The newly formed Constitutional Bench of the Supreme Court has recently admitted two 184(3) petitions filed by our clients. This is a rare feat because in the couple of week since it came into being, the Bench has dismissed hundreds of petitions on grounds of maintainability, while only a handful have been admitted.
Amongst these is a petition filed by Senator (r.) Abbas Afridi against systematic defiance of axle load laws by truckers on national highways. The Islamabad High Court has also issued directions to the Government in this regard. This causes thousands of road accidents as well as road damage amounting to billions every years and burdening the national exchequer.ย After hearing preliminary arguments by our Partner, Umer Ijaz Gilani, Advocate Supreme Court, the Bench issued notices to federal as well as provincial governments.
CUO 47 of 2024Last week, the court also issued notices in a petition filed by Hamza Khawaja, a student leader from LUMS and a number of other activists for removal of the ban on student unions. All the Advocate Generals were put on notice and they were directed to assist the Court.
Note: Recently, the Supreme Court has already directed all public sector universities in a 184(3) petition pleaded and argued by our partner, Omer Ijaz Gilani, to restore the student unions in the universities beyond any race or ethnicity.
