The Supreme Court in a case filed in the public interest has given the last chance to the Secretary of the Ministry of Climate Change for constitution of the Climate Change Authority. The Court had previously given a fortnight time period for constitution of the Authority, but it was not complied with. The Court showed utter dismay on this inaction and non-serious attitude of the Government and issued direction that the same be constituted before 15.08.2024. Otherwise, contempt proceeding will be initiated.
The Court clarified in the order that the Court is in hurry for the reason of upcoming monsoon season. The monsoon season in Pakistan causes havoc each year. The same is expected this year as well. If the Authority for climate change is in field well before the season, it may take preventive measures to avoid loss as much as possible.
It is to be noted that the monsoon rain spreads havoc each year across the country. Upon that, the Government is inactive and non serious, which is evident from the Court’s order. This inaction, willful negligence and non-serious attitude on the part of the Government expose it to tortious liability and damages. It implies that if loss occurs to the body or property of citizens due to the negligence or inaction on the part of the Government, the citizens may claim damages under the tortious liability. The Government owes duty of care to its citizen, defiance wherefrom may expose it to claims of damages.
