Election Law Practice at our Chamber

The various election laws of Pakistan provide for multiple kinds of election disputes: national elections, by-elections and local government elections, etc. Some examples of the litigation in this regard include:

1. Before the Election Commission of Pakistan

Decisions of Returning Officers or Deputy Returning Officers in all types of elections are assailable before the Election Commission of Pakistan. Furthermore, the Elections Act, 2017 provides the ECP with the authority to adjudicate certain miscellaneous disputes which arise out of the election process. While this is the general situation, professional advice about the precise merits of a cause can only be given after detailed assessment of facts.

2. Before the Election Tribunal

Once elections are concluded, the Election Commission of Pakistan establishes Elections Tribunals which are empowered to conduct a complete trial on complaints and election disputes submitted before it. Professional advice may vary on a case to case basis.

3. Before the High Courts

In certain circumstances, the High Court in its constitutional jurisdiction has the power to judicially review decisions of the Election Commission of Pakistan. While this is the general situation, professional advice about the precise merits of a cause can only be given after detailed assessment of facts.

Other frequent matters include:

1. Legal Opinions

2. Appeals before the Supreme Court
