Parliament has passed an Act named, the Members of Majlis-e-Shoora (Parliament) Immunities and Privileges
Act,2023, which provides, among others, to safeguard the members against the preventive detention. The Act says that a member of Parliament cannot be arrested under any law of preventive detention once the session of the Parliament has been called. Further, it provides that in case FIR or reference, as the case may be, has been lodged against any member, such fact shall be brought to the knowledge of the speaker. If the member is arrested and imprisoned by the court order, the committing judge shall intimate the order with reasons to the speaker.
