The Supreme Court Released its Judgment in Review in the Mubarak Sani Case:
The Supreme Court released its detailed judgment, written in Urdu, on review petitions in the Mubarak Sani case wherein the Sani was accused of religious blasphemy and dissemination ofย prohibitedย copies of the Holy Quran. The Supreme Court had previously released Mubarak Sani on bail and deleted certain charges against him as the offences were not made out in the case. There was only one offence for which he could be tied as per the contents of the FIR. The maximum punishment for that offence is six months imprisonment and he had spent 13 months in the jail, more than double of the punishment.
The Court in the review judgment has repeatedly referred to the Holy Quran and Hadeeth to explain that Islam protects the rights of minorities in Islamic State and it does not allow to suppress the minorities. The Court has also quoted the religious scholars who participated in the Special Committee proceeding which declared Qadyanis non-muslims. Those scholars had expressed their concerns regarding the rights of minorities at that time and had explicitly declared that rights of Qadyanis will be as protected as other minorities’.
The Court dismissed the review petitions except one filed by the Punjab Government in which the Government had asked for clarification that rights of Qadyanis as a minority are subject to reasonable restrictions as mentioned in the Constitution.
