Islamabad High Court in Writ Petition no.3159 of 2020 has rendered a unique judgment of its kind wherein the trial court has been urged not to be a silent spectator but to be vigilant to discover the relevant facts. Usually, it is assumed that our system is adversarial and the trail court is supposed to stand still thought proceeding of a case, surrendering completely into the hands of the parties to conduct the tail in whatever way they please. This judgment rebuts   this notion and holds that courts shall exhaust the available tools in C.P.C to reach the just conclusion at any stage of a case without going into tail of a case, if the documentary evidence is sufficient to adjudicate the matter conclusively.
