𝐌𝐚𝐢𝐧𝐭𝐞𝐧𝐚𝐧𝐜𝐞 𝐨𝐟 𝐚 𝐂𝐡𝐢𝐥𝐝 𝐈𝐧𝐜𝐥𝐮𝐝𝐞𝐬 𝐄𝐝𝐮𝐜𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐄𝐱𝐩𝐞𝐧𝐬𝐞𝐬 𝐚𝐬 𝐖𝐞𝐥𝐥. 𝐒𝐂

The Supreme Court has ruled that the word ‘maintenance‘ includes and cover those expenses which are incurred on education of a minor. The said word is not defined in any statute but taking its dictionary meaning and its connotation in Islamic Law, it becomes evident that it is the duty of a father to give to his children the financial support necessary for their well being, and well being cannot be read without education.

The Court further held that a father’s duty of care or maintenance towards  his children is erga omnes, which are those duties which one owes to the international community as a whole. It implies that a father’s obligation of maintenance is not limited to his kids alone but he owes the same to the international community as a whole as well.

The Court also referred to some Quranic Verses as to draw the conclusion that the obligation of fair and reasonable maintenance solely lies on the father and it covers every type of maintenance which is necessary for the well being of a kind, including educational expenses.
