The Rule Making Committee, constituted by the Islamabad High Court, has finally published in the official Gazette the proposed amendment to theย  CPC to elicit public objections/opinions with regard to the proposed amendments. Only a 30-day duration, commencing from the day of publishing in the official Gazette, has been provided for the submission of public opinions.

The proposed amendments primarily and substantially focus on expediting the disposal of civil suits. The amendments provide a comprehensive and holistic mechanism not only to conclude civil suits on early basis but also to curb the trend of filing false and frivolous cases by imposing costs under different heads.

The amendments also require the parties to attend the case management and scheduling conference called by the court and submit the case management statement in the court within seven days after the conference. This statement shall outline how the parties wish to proceed with the case, including the number and types of applications they intend to file, a list of witnesses, and undertaking regarding their readiness to give evidence. Additionally, the parties may also file interrogatories.

The amendments might have far-reaching consequences on the duration of civil suits. Hence, the public, especially the lawyers, are urged to read them thoroughly and provide their opinions to the Registrar of the IHC.
