The Parliament has recently passed a very crucial amendment act named, the Specific Relief (Amendment) Act, 2023 wherein the Parliament has made an amendment in section 42 of the Specific Relief Act, 1877 by providing a specific time frame to decide a declaratory suit and appeal against such suit. The amendment Act provides that a suit filed under section 42(1) shall be decided within 6 months after the suit has been filed and appeal against such suit shall be decided within 90 days period of time. Here is sub section 2 of section 42:
(21 Notwithstanding anything contained in any other law
for the time being in force, a suit filed under sub-section (1) shall
be decided by the Court within six months and the appellate court
shall decide the appeal not later than ninety days, as the case may
be.”.
